This policy describes BREATHE Midwives’ (“BREATHE Midwives”, “we”, “us”, “our”) general privacy and information practices with respect to the personal information and personal health information that we may collect about you during your visits to and use of our website, virtual care services or when you otherwise interact with us, how we use personal information and personal health information, and the manner in which personal information or personal health information may be disclosed or shared by us (“Privacy Policy”). At BREATHE Midwives, accessible from www.breathemidwives.ca, one of our main priorities is the privacy of our visitors. This Privacy Policy document contains types of information that is collected and recorded by BREATHE Midwives and how we use the information that is shared and/or collect on BREATHE Midwives. Consent

Unless an exception to consent applies, BREATHE Midwives only collects, uses or discloses your personal information and personal health information with your consent, which may be express or implied as required by applicable law. You may withdraw your consent at any time, subject to legal and contractual restrictions.

Website

By using our website, you hereby consent to our Privacy Policy and agree to its terms, which includes consent to the collection, use and disclosure of your personal information by BREATHE Midwives in accordance with the terms of and for the purposes set out in this Privacy Policy.

CLIENT PORTAL

When you register for a Client Portal Account on our website, your consent for us to collect your contact information and health card information will be implied through your conduct in providing this information to us in order to create an account. When you use our Client Portal to input and provide sensitive personal information, including personal health information, we will ask for your express consent for us to collect, use and disclose such information. Your use of our Client Portal is subject to our Client Portal Privacy Policy located at https://www.breathemidwives.ca/client-portal-privacy-policy/ as well as our Client Portal Terms of Use Agreement.

Information we collect

The personal information that you are asked to provide, and the reasons why you are asked to provide it, will be made clear to you at the point we ask you to provide your personal information.

If you contact us directly, we may receive additional information about you such as your name, email address, phone number, the contents of the message and/or attachments you may send us, and any other information you may choose to provide.

When you register for an account, we may ask for your contact information, including items such as name, company name, address, email address, and telephone number.

How we use your information

We use the information we collect in various ways, including to:

  • Provide, operate, and maintain our website
  • Improve, personalize, and expand our website
  • Understand and analyze how you use our website

Personal Health Information Protection Act, 2004  

The Personal Health Information Protection Act, 2004 (PHIPA) is Ontario’s health-specific privacy legislation. It regulates the manner in which personal health information is collected, used, and disclosed within the health care system.  

Personal health information is identifiable information about an individual which relates to:  

  • Physical or mental health of the individual, including family health history;  
  • Providing of health care to the individual, including the identification of a person as a provider of health care to the individual;  
  • Payments or eligibility for health care in respect of the individual;  
  • Donation by the individual of any body part or bodily substance or which is derived from the testing or examination of any such body part or bodily substance;  
  • The individual’s health number;
  • Identification of an individual’s substitute decision-maker.  
The Collection and Use of Personal Health Information  

We collect personal health information about you either from you directly or from a person acting on your behalf. The information that we collect may include your name, date of birth, address, personal and family health history, records of your visits BREATHE Midwives and the care that you received. You may enter, modify, and correct your personal health information via the BREATHE Midwives Client Portal. You may also obtain access to or request a correction to your record of personal health information by contacting BREATHE Midwives Staff. We may use your personal health information in order to deliver client care, administrate health care services, receive payment for your treatment and care, research, compile statistics, fundraise, meet legal requirements, and fulfill other purposes permitted or required by law. Your personal health information may be disclosed to midwives, health care professionals, and staff directly involved in your care. We are also required to disclose client information to several organizations, such as the Ministry of Health.  

The Safeguards  

We have instituted appropriate safeguards in our efforts to ensure that client’s personal health information is protected.  

Our Privacy Policy governs the manner in which all our employees access and manage client information. Our employees are required to sign a confidentiality agreement and our midwives are bound by the rules and guidelines instituted by the College of Midwives of Ontario in respect to privacy and confidentiality.  

Physical safeguards, such as facility access controls, workstation security, and mobile device security requirements, are in place in order to protect client records.  

Our client information system uses passwords and a firewall to protect the system from inappropriate accesses and from Internet users. The security capabilities of the client information system are also upgraded on an ongoing basis. In addition, the BREATHE Midwives Client Portal account is password protected, and confidential client information available through this portal is secured through encryption technologies.  

If your personal health information is stolen, lost, or accessed by unauthorized persons, we will notify you at the first reasonable opportunity.  

Log Files

BREATHE Midwives follows a standard procedure of using log files. These files log visitors when they visit websites. All hosting companies do this and a part of hosting services’ analytics. The information collected by log files include internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamp, referring/exit pages, and possibly the number of clicks. These are not linked to any information that is personally identifiable. The purpose of the information is for analyzing trends, administering the site, tracking users’ movement on the website, and gathering demographic information.

Cookies and Web Beacons

Like any other website, BREATHE Midwives uses “cookies”. These cookies are used to store information including visitors’ preferences, and the pages on the website that the visitor accessed or visited. The information is used to optimize the users’ experience by customizing our web page content based on visitors’ browser type and/or other information.

MailPoet newsletter & emails

If you have subscribed to our newsletter or if you are a member of our website (you can log in) or if you have purchased on our website, there is a good chance you will receive emails from us.

We will only send you emails which you have signed up to receive, or which pertain to the services we provided to you.

To send you emails, we use the name and email address you provide us. Our site also logs the IP address you used when you signed up for the service to prevent abuse of the system.

This website can send emails through the MailPoet Sending Service. This service allows us to track opens and clicks on our emails. We use this information to improve the content of our newsletters.

No identifiable information is otherwise tracked outside this website except for the email address.

Akismet

We collect information about visitors who comment on Sites that use our Akismet Anti-spam service. The information we collect depends on how the User sets up Akismet for the Site, but typically includes the commenter’s IP address, user agent, referrer, and Site URL (along with other information directly provided by the commenter such as their name, username, email address, and the comment itself).

Google Double Click DART Cookie

Google is one of a third-party vendor on our site. It also uses cookies, known as DART cookies, to serve ads to our site visitors based upon their visit to www.website.com and other sites on the internet. Google Analytics also uses cookies to collect standard internet log information and visitor behaviour information in an anonymous form. Third-party ad servers or ad networks uses technologies like cookies, JavaScript, or Web Beacons that are used in their respective advertisements and links that appear on BREATHE Midwives, which are sent directly to users’ browser. These technologies are used to measure the effectiveness of their advertising campaigns and/or to personalize the advertising content that you see on websites that you visit.

Note that BREATHE Midwives has no access to or control over these cookies that are used by third-party advertisers.

BREATHE Midwives’ Privacy Policy does not apply to other advertisers or websites. Children’s Information

Another part of our priority is adding protection for children while using the internet. We encourage parents and guardians to observe, participate in, and/or monitor and guide their online activity.

BREATHE Midwives does not knowingly collect any Personal Identifiable Information from children under the age of 13. If you think that your child provided this kind of information on our website, we strongly encourage you to contact us immediately and we will do our best efforts to promptly remove such information from our records.

Retention of Personal Information and Personal Health Information

BREATHE Midwives will retain your personal information and personal health information only for so long as is necessary to fulfill the purpose for which it was collected and to meet our legal and contractual obligations. We retain personal health information for at least the minimum retention period required by the College of Midwives of Ontario. Where personal information is no longer needed, it will be securely destroyed or permanently anonymized or de-identified.

Modification to Privacy Policy  

We reserve the right to change our Privacy Policy. A revised Privacy Policy will apply only to data collected subsequent to its effective date. Any revisions will be posted at least 15 days prior to its effective date.
